March 08, 2001 The City Council met in special session on Wednesday evening, March 07, 2001 at 6:45 p.m. with Mayor Harold 1- Ludwig presiding and the following Councilmen present. Lowe, Griesbaum, Wiewel, Rossiter, Sherwood and Martin. Also present at this meeting City Attorney Kruse. Mayor Ludwig read a letter to the Council, that the City had received from tLarry Seckington on behalf of Mark Twain Gaming. Seckington was asking for an accounting of the first advancement of $100,000 and monthly accounting of the future advancement of $200,000. Kruse stated there is nothing in the agreement where the City would be required to send this information to Seckington. Sherwood slated to just send a summary of the original list and add the cost of the items not listed for the Fire Dept. Martin motioned to send a copy of the bills and treasurers report to Seckington and highlight the wages and items purchased for the Police and Fire Dept., per the list submitted. Sherwood second the motion. Motion carried all six yes. Kruse stated they are going to rework the Franchise Agreement. Mark Twain Casino has asked if the Council would be willing to take the first advancement of $100,000 that was taken from the fifth year to the first year, along with the second advancement that was taken off the first year. They would also like to see the requested advancement of $200,000 to be taken off of the second year. Martin stated he had concerns with moving the money from the last years rent to the first couple of years. There are going to be other things coming up where this other half of the rent could be used. Rossiter stated he agreed with Martin. Kruse stated according to the agreement any advancements would come off of the fifth year, then the fourth and so on. Wiewel motioned to have the City Attorney to enter into an agreement with Mark Twain Casino to leave the previous advancements where stated and to take the next advancement of $100,000 off of the second and $100,000 out of the third year dockside agreement. Rossiter second the motion. Motion carried all six yes. City Attorney Kruse will fax agreement to Seckington on 03/08/01.

Having nothing further before the Council, Martin motioned to adjourn. Lowe second the motion. Motion carried all six yes.
